Our puppies receive a full puppy exam and are approved by our veterinarian prior to adoption. *The seller guarantees that the puppy is in good health (minus potential intestinal parasites) and has received the following: age-appropriate immunizations, deworming, and a health certificate including immunization records which will be available at the time the Buyer takes possession of the puppy.I understand and agree *The seller provides warranty against debilitating congenital defects for a period of 1 year after the date of sale. By clicking the check box I agree I understand and will adhere to the statements and conditional information listed below.A. Debilitating congenital defects are defined as those present since birth that are either life-threatening or would prevent the puppy from fulfilling the intended purpose for which it purchased. B. Any suspected debilitating congenital defect must be confirmed by a licensed veterinarian and buyer must supply any requested veterinary records related to the dog’s condition to the seller within seven days. Seller has the right to require a second opinion from a veterinarian and/or veterinary specialist of the Seller’s choice at the Seller’s expense.. C. If necropsy is performed and it results in undetermined or inconclusive diagnosis of congenital defect, warranty is void. D. If a congenital defect is identified and documented within the warranty period, the Buyer has the option to obtain a replacement puppy from Seller of equal or lesser value from the next available litter. Color and gender are not guaranteed and the wait time may be as long as 6-12 months. E. If the puppy dies within the warranty period, cause of death must be confirmed by a licensed veterinarian along with documentation that the puppy’s death was the result of a congenital defect in order for warranty to apply. F. Original transportation fees will not be refunded, and any costs associated to pick up replacement puppy is to be covered by the Buyer. G. If the puppy is euthanized or in any way disposed of, proper documentation of immediate life- threatening congenital defect from a licensed veterinarian will be required. Additionally, a second opinion from the Seller’s veterinarian may be necessary in order for warranty to apply. H. This warranty does not include viral illnesses, infections, improper bites, stress-related illness, hernias, hypoglycemia, parasites (including Giardia or Coccidiosis), cancer, or endocrine disorders. It also does not include any illness due to ingestion of foreign objects, food, chemicals, or physical injury. I. No warranties or guarantees, expressed or implied are made under this contract except as stated. J. This warranty is non-transferrable.I understand and agree *Under no circumstances shall the Seller be liable to the Buyer or to any third party for any consequential, incidental, or special damages resulting from or in any manner related to the puppy/dog once transfer of ownership has taken place.Buyers Responsiblities - The Buyer agrees to pay the Seller a total sum of (including deposit) in the amount listed below for the puppy listed above. **List purchase priceI understand and agree as the buyer *to have the puppy examined by a licensed veterinarian within THREE days of taking possession. We cannot control what the puppy comes in contact or is exposed to after leaving us, so if you choose not to have your puppy examined within these three days then the health warranty is void. If within 72 hours of receiving the puppy, it is determined to be at risk due a life-threatening congenital defect, Buyer must contact the Seller within this time period and provide a written statement from a licensed veterinarian stating the puppy’s defect. If a defect is determined, the Buyer has the option of returning puppy to the Seller, at Buyer’s cost, for a full refund. The Breeder reserves the right to a second veterinarian opinion of the puppy’s condition at Buyer’s expense.I understand as the buyer I am *responsible for all medical expenses associated with the treatment of intestinal parasites if the puppy is diagnosed, even if puppy has parasites present when sent home. It is common for puppy parasites to flourish after joining their new family due to stress and having to adapt to a new home.I understand as the buyer I *agree to provide a life-long commitment, comfortable environment, prompt medical attention, proper grooming and responsible care. This includes keeping the puppy parasite free, having puppy seen by licensed veterinarian for yearly wellness exams, staying up to date with immunizations, providing proper nutrition which consists of feeding a premium quality dog food, and providing fresh water at all times.As the buyer *understand that all puppies exhibit certain undesirable behaviors (nipping, chewing, barking, marking, compulsive actions, etc). This is normal behavior for a young dog. Buyer is responsible for appropriate training to correctly teach acceptable behaviors and is responsible for proper socialization of the dog. Puppy training classes or other training classes are best practices for developing well behaved, socialized dogs.As the buyer *I understand the temperament, ability to potty train, size of dog, length of coat, amount of shedding, or any uncontrollable factors cannot be guaranteed.The buyer agrees *to contact the Seller if the Buyer determines they are unable to keep their puppy for any reason. The Buyer and Seller will jointly determine how the dog will be rehomed. The Buyer agrees to never place their puppy in an animal shelter, pound, pet store, or similar facility.I understand *Upon execution of this contract all veterinary care and its associated costs are the sole responsibility of the Buyer.Spay | Neuter Contract - As the buyer I agree *to spay/neuter puppy unless full breeding rights have been purchased. The puppy must be spayed or neutered by 12 months of age. Proof of this, in the form of a Spay or Neuter Certificate signed by a licensed veterinarian must be forwarded to Seller by the time the puppy reaches 13 months of age. A monetary penalty up to an average value of a litter may be imposed if dog has not been spayed or neutered within the allotted time or dog has been bred on purpose or by accident.Additional Terms & Conditions *If any action or failure to act on the part of Buyer shall result in any claim, suit, loss, damage, injury, death, or liability, Buyer agrees to defend, indemnify, and hold Seller harmless and to pay all of Seller’s costs and expenses, including reasonable legal fees, and any amount paid in settlement and any award judgment with respect thereto. This agreement shall be construed under, and in accordance, with laws of the State of Kansas, and the venue for any legal action arising out of this agreement shall be in Sedgwick County, Kansas. Buyer releases Seller from any and all liability, costs or damages caused either directly or indirectly by the puppy/dog after placement with the Buyer, including but not limited to damage to or destruction of property, and injury to any person or animal. I have read the above Agreement and understand and agree with the terms set forth in this document. I also understand that this is a binding contract and will abide by the terms we have agreed upon.
